WEDDING & EVENT PHOTOGRAPHY AGREEMENT

This Agreement has been created to protect all Parties involved, while ensuring thorough communication and a mutually positive experience.

A non-refundable deposit of 50% for weddings and events (the “Deposit”) is required to reserve a date and time for Dana Siles Photographer (the “Photographer”) to photograph your wedding or event on the agreed upon Wedding or Event date(s) set forth below (your original “Date”). If a second shooter is required for your wedding or event, an additional $500 non-refundable deposit will be applied. The balance is due three weeks prior to your Date. You (the “Client” and/or “Bride” and/or “Groom”) agree that if the second Deposit and/or Balance are not received by the specified date, Photographer may be released from any and all obligations hereunder; and products will not be delivered until after balance is received. You agree that if the Date is changed for any reason, the Photographer has the right to retain the Deposit and/or be released from any and all obligations hereunder. In the event Photographer is available and agrees to the changed Date, you agree to pay an additional non-refundable equal deposit for the changed Date. If, after payment of the additional equal deposit, Photographer secures another equivalent job for the Original Date, the additional equal deposit, together with the original Deposit shall be applied against the total amount due hereunder. The Client agrees that if timely payment in full is not made, then Photographer shall be under no obligation to provide the services set forth herein.

Photographer acknowledges that her services are of a personal, unique nature and that she may not assign her obligations under this Agreement without Client’s prior written consent. If by circumstances beyond Photographer's control, she cannot photograph your Wedding or Event as previously agreed, maximum efforts will be made to provide a comparable photographer who is acceptable to you (at no additional costs to you). All conditions and fees of this agreement will apply. If a comparable photographer is not available, Dana Siles Photographer will refund 100% of prior payments. Photographer shall use all reasonable efforts in fulfilling the required services agreed to herein and warrants that all services will be performed in a professional, workmanlike manner, in accordance with industry standards. It is agreed by The Client to indemnify and hold Photographer harmless for any third party claim for invasion of privacy from the result of her services provided pursuant herein.

Coverage and Complete Collections products are available three to eight weeks after the Client’s date; A minimum of 80 or more image files (Photographer’s “Selects” and/or images in The Client’s album) will be completely edited with final touches; Non ”Select” files are lightly edited without final touches (cropping, density or color corrections may still need to be made based on reproduction specifications). Wedding album order(s) and print order(s) may be purchased separately from wedding photography or included in Coverage or Complete Collections, on the terms and conditions set fourth below. All Print and Album orders are collaborative between Photographer and the Client. Print orders are complete two to eight weeks from order date. A 50% order deposit (the “Order Deposit”) is required before work on your prints and album(s) commences. Album orders are complete two to eight months from order date (Custom Heirlooms average 6-7 months and Fine Art albums average 3-4 months). Order date begins once Photographer has received written or electronically documented album plan approval and the Order Deposit (if a la carte); balance is due prior to Photographer shipping the finished work. Prices are valid for weddings within 90 miles of Pawtucket, RI. Prices quoted for services, albums, files and prints will remain in effect for six months after wedding/event date. After six months, all rates are subject to change.

All Prints and Albums are the property of the Client. All original Digital Raw Capture files and original film negatives shall remain the sole and exclusive property of Dana Siles Photographer. Any and all high resolution print-ready JPG files shall remain the sole and exclusive property of Dana Siles Photographer, until either (A) after a complete Heirloom Album has been made and completed for and purchased by the Client (Collections); or (B) Client has purchased just Coverage, including high-resolution JPG files of their wedding/event photographs (each, the “Transfer Date”). If client who previously purchased Collection expresses interest to receive High Resolution JPG files in lieu of their completed Heirloom Album, Dana Siles Photographer has up to eight weeks turn-around before sending to client and is not obligated to provide refunds of any previous payments or to apply these payments to future purchases. If Client has not purchased a complete Heirloom Album or High Resolution Digital JPG files by 18 months from the date of the event, Photographer reserves the right to destroy any or all of the negatives and/or original Digital Raw Capture files, which means eliminating the negatives and replacing the original Digital Capture files with high-resolution JPG files. Three logged attempts to contact the Client will be made prior to destroying the negatives and/or original Digital Raw Capture files.

Shipping & Handling for all products included in your original Coverage or Collection is included for no additional fees. Packages containing Albums must be signed for unless otherwise specified by Photographer or Client. Shipping & Handling for print and album orders will be billed to recipient or a S/H fee will be added.

Dana Siles Photographer takes utmost care with the exposure, development and delivery of the photographs. However, in the event Dana Siles Photographer fails to comply with the agreed terms of this contract due to any event or act outside the control of Dana Siles Photographer, Dana Siles Photographer’s liability is limited to return of amounts paid.

Dana Siles Photographer reserves the right and has official permission from The Client to use any photograph(s) from your wedding or event(s) for commercial, stock and personal use, including but not limited to internet and/or print publications for purposes such as: portfolio, Real Wedding feature(s), Real Event feature(s), studio and/or public display, social media, editorial(s), advertorial(s), advertisement(s) or publication(s). Client agrees to fill out a brief questionnaire and/or accept a brief interview for Real Wedding features upon request.

It is illegal to copy or reproduce any photographs taken by Dana Siles Photographer without prior written permission, until after the Transfer Date. Violators of this Federal Law will be subject to its civil and criminal penalties. After the Transfer Date, The Client has permission to reproduce any photograph from those negatives and/or digital files for personal use as prints. The Client does not have permission to reproduce any photographs from those negatives and/or digital files for social media. Files eligible for sharing via social media are solely those with the visible Dana Siles Photographer watermark included on the Client’s Flash Drive in the specified folder. Client agrees not to crop the logo of Dana Siles Photographer when sharing images online and via email and to request recipient(s) to follow suite. This is to prevent unauthorized and illegal Commercial Use. If additional images are requested for online sharing, Client may contact Dana Siles Photographer to obtain an edited, watermarked file. The fee is complimentary per each additional edited, watermarked file up to 10 files and will be turned around within one to eight weeks of request via electronic transfer. All high resolution files include traceable metadata. Images may not be reproduced, distributed, published or displayed in any way electronically or in print for any business or commercial use by or for you or a third party. Dana Siles Photographer retains official Copyright Ownership of every photo from your wedding/event. You agree not to claim any photograph taken by Photographer as your own, or a third party’s work.

Dana Siles Photographer requires that she and her assistant(s) be supplied with a hot, vegetarian meal at your wedding, to be timed with the guests' main course so that no photo opportunities are missed while Photographer and her assistant(s) eat for 15 minutes. If any changes of schedule or location occur, the Client will notify Photographer immediately.

It is agreed that if the Wedding or Event location exceeds 90 miles from Pawtucket, RI, the client will provide Dana Siles Photographer and her assistant(s) with hotel accommodations and applicable parking for one or two nights, depending on both the distance and schedule. If location is beyond the standard travel area, Client will cover airfare or pay a $1.00 per mile travel fee for each additional mile, each way. Client will provide Dana Siles Photographer and her assistant(s) with hotel accommodations and applicable parking for one or two nights upon request if Client purchases Rehearsal Dinner and/or Brunch photography combined with the wedding photography.

Rhode Island State Sales Tax must be paid in the amount of 7% on all purchases unless otherwise specified in a logged email. Client may be responsible for paying sales tax in their State when products are shipped outside of the State of Rhode Island. Dana Siles Photographer accepts PayPal, personal and business checks. If client wishes to purchase via Wire Transfer, a $15 transfer fee will be applied to purchase. There will be a $25.00 fee imposed on all returned checks.
